Colorado shooting suspect charged with 24 counts first-degree murder

CENTENNIAL, Colo. (Reuters) - The former graduate student accused of opening fire at a midnight screening of the new "Batman" film in Colorado, killing 12 people, was charged on Monday with 24 counts of first-degree murder and 116 counts of attempted murder.

James Holmes, who was arrested behind the Century 16 multiplex in the Denver suburb of Aurora moments after the July 20 shooting at a packed showing of "The Dark Knight Rises," made his second court appearance on Monday.

Fifty-eight people were wounded, some of whom remain in critical condition.

The first-degree murder charges make him eligible to face the death penalty, although prosecutors have not yet said whether they would seek it in the case.

Prosecutors essentially charged Holmes with two murder counts for each victim - one standard first-degree murder charge plus one count of murder with extreme indifference. They also filed two attempted murder counts for each of the wounded survivors.

Holmes, 24, who authorities say styled himself after Batman's comic-book nemesis "the Joker," appeared in court clad in jail garb, his hair still dyed bright orange but with the color fading to pink in places.

He sat impassively at a table with two defense lawyers through the 45 minute hearing but seemed more alert than during his initial court appearance a week ago, when he looked dazed and groggy.

The former neuroscience student spoke only once, quietly answering "yes" in response to a question from Arapahoe County District Judge William Sylvester. He mostly kept his gaze lowered and did not look at a courtroom gallery packed with members of the media and victims' family members.

The judge set a pre-trial hearing for September 27 and tentatively scheduled a preliminary hearing for the week of November 13.

Police say Holmes entered Theater 9 wearing tactical body armor and a gas mask and tossed smoke bombs before spraying moviegoers with bullets from three guns.

Authorities who rushed to his apartment following the movie house massacre found it wired with enough explosives to bring down the three-story building and spent several days painstakingly dismantling the booby traps. Holmes was also charged on Monday with possessing an explosive device.

Pregnant survivor Ashley Moser suffered a miscarriage following the shooting but the loss of her fetus did not alter the number of murder charges because under Colorado law the unborn cannot be counted as homicide victims.

Moser, 25, was left paralyzed from the waist down from her own bullet wounds. Her daughter, 6-year-old Veronica Moser-Sullivan, was the youngest of those who died in the shooting.

THE JOKER

During the hearing, defense attorney Tamara Brady asked that prosecutors turn over evidence collected in the case. The defense is seeking a package that news reports have said was sent by Holmes to a University of Colorado psychiatrist, Dr. Lynne Fenton.

Prosecutors responded that they had not yet opened that parcel, which according to Fox News contained a notebook outlining his plans for the shooting, including stick-figure drawings.

Holmes, a San Diego native, was a doctoral student of neuroscience at the university's Anschutz campus before turning in paperwork to drop out in June. Court documents filed on Friday by defense lawyers said he had been under Fenton's care.

Police have not offered a motive for the shooting rampage that stunned the community of Aurora and evoked memories of the 1999 massacre at Columbine High School less than 20 miles away in Littleton.

Authorities have said that following his arrest, Holmes had called himself "the Joker" and experts say his mental state could play a key role in the case.

The judge set an August 9 date to consider requests from attorneys representing news organizations to unseal court records and investigative documents. He also said he would hold a hearing on August 16 to determine what evidence should be considered protected between Holmes and his psychiatrist.

Following the hearing, Moser's aunt, MaryEllen Hansen, said she found Holmes a "diabolical, evil presence."

"But he looked very sane to me, he really did. His reaction looked different," Hansen said. "When we've seen him before he looked like he was kind of spaced out or out of touch. But he seemed very, very alert today and very lucid as to what was going on."

"The guy's a coward and he looked defeated because he knows he's not the one with the power any more, we are," said U.S. Marine Donald Lader, who was in Theater 9 at the time of the shooting but escaped injury.

Holmes was armed on the night of the shooting with a Smith & Wesson M&P .223 semi-automatic rifle, similar to an AR-15 assault rifle; a 12-gauge shotgun and a Glock .40-caliber handgun, according to police.

An additional Glock .40-caliber handgun was found in his car. All the weapons had been bought legally in the previous 60 days.

When copyright or other intellectual property restrictions expire, works will enter the public domain and may be used by anyone.

Publishing the details of an invention before applying for a patent will generally place an invention in the public domain and prevent its subsequent patenting by others. There is an exception to this; however, in U.S. law, the rightful inventor may file a patent claim up to one year after publishing it.

Trade Secrets

If guarded properly, trade secrets never enter the public domain. For example, a business may keep a product formula like that for Coca-Cola a secret indefinitely. However, if it is disclosed to the public, the former secret enters the public domain, although the former secret may still be patented in the United States.

Trademarks

A trademark registration is renewable. A trademark owner may maintain a registration indefinitely by paying renewal fees, using the trademark and defending the registration.

However, a trademark or brand may become a generic term for a particular type of product or service if people do not use it as a trademark (i.e. as a name or graphic representation exclusively identifying that that product or service originates from a particular business).

A genericized trademark ? sometimes known as a generic trade mark, generic descriptor or proprietary eponym ? is a trademark or brand name which has become synonymous with the general or formal term for a particular type of product or service, to the extent that it often replaces this term in colloquial usage.

One famous U.S, example is ?thermos?. An interesting philosophical issue is that a manufacturer who invents an amazing breakthrough product which cannot be succinctly described in plain English (for example, a vacuum-insulated drinking flask) will inevitably find its product described by the trademark (?Thermos?). If the product continues to dominate the market, eventually the trademark will become generic (?thermos?). Other examples are: escalator, trampoline, raisin bran, linoleum, dry ice, shredded wheat, mimeograph, yo-yo, nylon, kerosene, cornflakes, cube steak, lanolin, and high octane, masonite, allen wrench, pabulum, styrofoam, and zipper.

One consequence of a trademark becoming generic is that the exclusive rights which may attach to the use or registration of the trademark can no longer be legally enforced. Genericide typically occurs over a period of time where the trademark owner does not maintain or enforce its proprietary rights (e.g. by using the mark or by pursuing infringement action).
However, genericide is not an inevitable process. In the late 1980s ?Nintendo? was becoming synonymous with home video game consoles but Nintendo was able to reverse this process through marketing campaigns. Xerox was also successful in avoiding its name becoming synonymous with the act of photocopying.

Domain Names

A domain name, which may be bought and sold, never enters public domain. If nobody owns it, it simply doesn?t exist. Top level domains, such as .com, are controlled by the Internet Corporation for Assigned Names and Numbers.

Apple buying AuthenTec for about $356 million

NEW YORK (AP) ? Apple has agreed to buy fingerprint reader AuthenTec Inc. for approximately $356 million as the company known for iPhones and iPads looks to strengthen its digital security capabilities.

Apple disclosed in a regulatory filing that it will pay $8 for each share of AuthenTec, a 58 percent premium to thei closing price on Thursday.

AuthenTec's stock jumped $3.30, or 65 percent, to $8.37 in Friday afternoon trading ? above the offered price.

The transaction was unanimously approved by AuthenTec's board. It still requires approval from a majority of the holders of AuthenTec stock. AuthenTec currently has about 44.5 million outstanding shares, according to FactSet.

Shares of Apple Inc., based in Cupertino, Calif., gained $4.70 to $579.58.

This happens because the organization with its various policies, practices, and culture is not ready for change.

Some of the information you will need to know to determine how ready your organization is for change are the following:

  • Does this change effort support other major activities in the organization?
  • Are we rewarding people for being innovative, taking risks, and solving problems?

As you gather this information, you?may identify some significant obstacles that require immediate attention before you launch an organizational change effort. This could be an operational or equipment change or reallocation of resources to support the pending change effort.?The alternative?launching the change without addressing significant organizational obstacles?fosters employee cynicism.

3.?How ready are my employees for this organizational change?

Employees are the critical group for the successful implementation of any change effort. When employees are not ready for change and are forced to do so by management, they will find a way to resist. Employee resistance can be indifference (loss of interest in their work), passive (doing only what they are told to do), and active (sabotaging the effort with deliberate errors or by slowing down). Senior leaders do well when they take steps to minimize employee resistance before the launch of a change effort.

Some of the information you will need to know to determine how ready your employees are for change are the following:

      • Do my employees understand our customers? needs?
      • What is the state of employee morale in the organization?
      • Do my employees feel personally responsible for their success in the organization?

The advantage for you of assessing the readiness of your managers, organization, and your employees prior to launching a change effort is that it gives you a realistic overview of what is truly needed to implement organizational change. As you thoughtfully work with your leadership team, managers, and employees with a change model like Lewin?s or Kotter?s, you will already have addressed critical barriers that would have derailed the change effort at its launch. You?ll also understand the sustained time and commitment that will be necessary to undertake meaningful organizational change in your company.

Romney goes to Europe, causes international stir

LONDON (AP) ? Republican presidential candidate Mitt Romney caused a stir in Britain on Thursday by questioning whether the country is prepared to pull off the Olympic Games without a hitch and scheduling a fundraiser with the former leader of a troubled bank.

On the first full day of his trip abroad, the former Massachusetts governor visited British political leaders as part of a larger effort to show he has what it takes to represent the U.S. on the world stage. But instead of highlighting ties with the America's staunchest ally, Romney may have embarrassed the Brits instead.

Romney launched a three-nation tour this week designed to bolster his foreign policy credentials and highlight his personal Olympic experience. Romney led the 2002 Winter Games in Salt Lake City, Utah, and used the games to launch his political career.

But the trip got off to a shaky start.

Romney openly doubted whether Britain could handle the games, saying it was unclear whether issues that have dogged the final preparations could be overcome.

"It's hard to know just how well it will turn out," Romney told NBC News in an interview on Wednesday, two days before the opening ceremonies.

Romney later met with Prime Minister David Cameron, and they discussed the Olympic Games in addition to alliances in Afghanistan and Syria.

"I expect the games to be highly successful," Romney declared after the meeting.

Earlier Thursday, Romney and Cameron seemed to address each other through the media. After Romney suggested it's impossible for any Olympic Games to go off without a hitch, Cameron said Romney and others will "see beyond doubt that Britain can deliver."

At the same time, Romney faced scrutiny for a London fundraiser Thursday night that's expected to attract employees of Barclays, which has been in the spotlight after becoming the first bank to admit its employees were involved in manipulating a key market index.

Last month, U.S. and British agencies fined Barclays a total of $453 million. In the wake of that shock, chief executive Bob Diamond resigned. Diamond had been scheduled to attend the fundraiser at the Mandarin Oriental hotel in the tony Knightsbridge district, but has pulled out. He already had sent Romney a check for $2,500.

Romney sought to steer the conversation away from the controversies.

"The world is a tumultuous and dangerous place," Romney said Thursday. "And certainly in many of the regions around the world we have great interests in having a common effort in seeing greater peace and prosperity."

As he met with British leaders past and present, the Republican also praised "the unique relationship that exists between our nations, our commitment to common values, our commitment to peace in the world and a desire to see a stronger and growing economy."

Romney, whose decades in private business gave him ample exposure to international affairs, is a former one-term governor untested on the world's political stage. He hopes to convince voters back home that he is no novice on foreign affairs and that they should feel confident electing him as president in a complex world and with the U.S. facing a myriad of security threats.

During the public portion of his meeting with Cameron, Romney weighed in again after his comment about the Olympics drew attention across Britain. "It is impossible for absolutely no mistakes to occur," he said. "Of course there will be errors from time to time, but those are all overshadowed by the extraordinary demonstrations of courage, character and determination by the athletes."

Meeting with British officials is typically one of the first priorities of any new president, and establishing those relationships beforehand can help smooth any transition. It's not unusual for American presidential candidates to meet with British leaders during the campaign; Obama did so when he took a trip abroad as the likely Democratic nominee in 2008.

Romney's weeklong trip also will take him to Israel and Poland.

On Thursday, Romney also met with former Prime Minister Tony Blair; Ed Miliband, the current leader of the Labour Party ? the opposition to Cameron's Conservative Party; and Foreign Secretary William Hague. The candidate also met with Nick Clegg, the deputy prime minister, and Chancellor of the Exchequer George Osborne, Britain's top financial official.

On Friday, Romney is scheduled to attend the opening ceremonies of the London Games.

This wasn't Romney's first meeting with Cameron; the two talked when Romney visited London in 2011. Cameron visited the U.S. earlier this year to meet with Obama and attended a White House state dinner, but he did not meet with Romney.

The meetings come a day after the Daily Telegraph published a story quoting an unidentified Romney campaign adviser saying the Republican believes the U.S. relationship with Britain is special because of shared "Anglo-Saxon heritage" that the adviser said the White House doesn't appreciate.

Romney, however, quickly distanced himself from any such view.

"I don't agree with whoever that adviser might be," Romney told NBC News, "but do agree that we have a very common bond between ourselves and Great Britain."

Nonetheless, Vice President Joe Biden and top Obama aides criticized Romney. "The comments reported this morning are a disturbing start to a trip designed to demonstrate Gov. Romney's readiness to represent the United States on the world's stage," Biden said.

Accompanying Romney to some of his meetings Thursday were former Missouri Sen. Jim Talent, an adviser, and Kerry Healey, who served as lieutenant governor when Romney was governor of Massachusetts. Three of Romney's sons ? Tagg, Josh and Craig ? also have joined him in London.

(AP) ? Derek Holland is intent on making up for the time he missed on the mound for the Texas Rangers, who keep winning series at home.

The left-hander certainly seems to be getting back into form after missing a month because of shoulder fatigue brought on when he lost about 15 pounds when he had a stomach virus.

Holland retired 20 of 22 batters over one stretch Wednesday night and struck out seven in 7 2-3 innings, and the Rangers scored the go-ahead run after a couple of wild throws by Josh Beckett in a 5-3 victory over the Boston Red Sox.

"I'm trying to do everything I can to step up and get those innings back, that I had lost in the month off," Holland said. "I put the pressure on myself. Obviously everybody else wants me to step things up, but I feel like I'm kind of doing it on my own."

The Rangers took two of three against Boston to win their seventh consecutive series at home. It came during a three-day span when they found out right-hander Colby Lewis was done for the season with a torn flexor tendon and Roy Oswalt skipped his scheduled start because of back stiffness.

In his fourth start since coming off the DL, Holland (7-5) allowed three runs and five hits with one walk.

"We needed exactly what he gave us," manager Ron Washington said. "He competed. He gave up two home runs, but he didn't let it affect him and kept getting after it."

Elvis Andrus was hit on the left forearm by a pitch to reach with one out in the seventh. He got to third on a single by Adrian Beltre and scored to break a 3-all tie when Beckett (5-9) threw a wild pitch that bounced several feet wide of the plate.

"Josh gave us a zero in the first inning, as promised, and pitched a good game," Boston manager Bobby Valentine said. "Nobody on in the seventh, then a wild pitch to score a go-ahead run. ... It's a damn shame."

Beltre was back in the lineup a day after being hit by a pitch thrown by Vicente Padilla that knocked off his helmet and sent him to the ground. Beltre, who insisted again before Wednesday's game that he didn't think that 0-2 pitch was purposely thrown at him, had a bruise but no concussion.

In what may have been a bit of retaliation with two outs in the first, Red Sox cleanup hitter Adrian Gonzalez was hit in the buttocks by a pitch. Home plate umpire Tim Tschida, the crew chief, pointed Gonzalez to first base and didn't issue any warnings.

There were no further issues, and it was clear by Beckett's reaction when he hit Andrus in the seventh that it was just a pitch that got away.

While retiring 20 of 22 batters, Holland gave up solo homers to Will Middlebrooks and Dustin Pedroia. He struck out the side in the seventh. The impressive stretch ended when Pedro Ciriaco had a two-out single in the eighth with Pedroia on deck.

Mike Adams retired Pedroia on a running catch by left fielder David Murphy. Joe Nathan worked a perfect ninth for his 20th save in 21 chances a day after allowing consecutive two-out walks and then giving up a run in a 2-1 loss to the Red Sox.

Beckett, who allowed nine hits and walked two in his seven innings, never appeared in the clubhouse when it was open to reporters after the game.

Jacoby Ellsbury drew a walk to start the game and eventually scored when Pedroia grounded into a double play.

Holland began his impressive streak after Middlebrooks led off the second with a single. Middlebrooks hit his 12th homer in the fourth, and Pedroia went deep in the sixth.

The Rangers scored three times in the fourth, when they got started with doubles by Michael Young and Murphy. It was Young's first extra-base hit in 11 games since the All-Star break, and Murphy's first RBI since June 28.

Murphy scored on Craig Gentry's perfectly executed suicide squeeze bunt to tie the game at 2. Ian Kinsler followed with an RBI bloop single that dropped after glancing off the heel of sliding right fielder Cody Ross' glove.

"We did some good execution," Washington said. "So it worked out for us."

Notes: Cruz was mired in a 5-for-33 slump with 11 strikeouts over 10 games before leading off the eight with a homer off Red Sox reliever Matt Albers. ... Economic challenges such as financial instability and unemployment are also making many young adults to develop Schizophrenia.

Schizophrenia occurs in stages that continue advancing if no medical measures are taken. However it is worth noting that the disorder is more severe if it developed during the young age of an individual. The first stage of the disorder is the prodromal stage. This is the early stage of schizophrenia. At this stage it is not possible to diagnose schizophrenia since the symptoms are not specific. The next stage is the acute stage where the patient starts developing specific schizophrenia symptoms. This is the active stage of the disorder and the patient after some time the patient advances to the residual stage of schizophrenia has which similar symptoms with prodromal stage.

Although the disorder is chronic it does not mean that individuals suffering from schizophrenia cannot help recover from their illnesses. Research shows that with adequate support from the family members and community members, individuals suffering from schizophrenia can do things by their own and live responsible lives. All that they need is adequate counseling and medication. The condition is easily treatable if it is realized in the early stages when little damage has occurred in the brain.

Therefore parents should be very observant in order to determine when their children are developing schizophrenia so that they can give them the necessary therapy, medication and support. In order to check whether a person is developing schizophrenia, it is important to monitor whether the person like staying alone, he/she is motionless, irrational reasoning, speaks in a strange manner, over sleeping or lack of sleep and poor hygiene. When an individual develops the above symptoms, he/she is likely to develop schizophrenia. It is therefore important to visit a psychiatrist in order to seek further clarification and take the necessary medical measures.

In February 2009 <a href="http://www.washingtonpost.com/wp-dyn/content/article/2009/02/06/AR2009020602850.html" target="_hplink">he wrote an op-ed for <em>The Washington Post</em></a> as a plea to Congress to "vote for the maximum funding to let the National Institutes of Health fight cancer and other life threatening illnesses" as part of the stimulus package: <blockquote>When I was growing up in Texas, my family had a simple response for challenges like this: "Stop talking about it, and <em>do</em> something about it." That's how I feel about finding more money for cancer research. My hope is that some day, the words "a cure" won't be followed by the words "is impossible."</blockquote> He died 20 months after diagnosis. His wife, Lisa Niemi, has stayed active in raising awareness around pancreatic cancer, <a href="http://www.pancan.org/section_about/national_spokesperson/" target="_hplink">signing on as a national spokesperson for the Pancreatic Cancer Action Network</a>. "My husband Patrick not only touched the lives of millions with his work, but also with the strength and courage he displayed during his fight against pancreatic cancer; he was a hero around the world," <a href="http://www.pancan.org/section_about/national_spokesperson/" target="_hplink">she said when announcing a new awareness campaign for the organization</a>. "While it is bittersweet to mark this day, it is imperative that people understand the severity of this disease and the urgent need for increased research funding,"

  • Randy Pausch

    A <a href="http://www.thelastlecture.com/aboutr.htm" target="_hplink">professor of Computer Science, Human Computer Interaction and Design</a> at Carnegie Mellon University in Pittsburgh, Pausch delivered his last lecture in September 2007 after learning he was dying of pancreatic cancer. He died 11 months later on July 25, 2008 -- <a href="http://www.huffingtonpost.com/2008/07/26/randy-pausch-last-lecture_n_115137.html" target="_hplink">five months past the six months his doctors</a> once (optimistically) gave him to live.

    The founder and CEO of Apple may be the most public face of pancreatic cancer in the United States, having battled the disease for an estimated seven years before succumbing to it at the age of 56. For the rare form of pancreatic tumor that Jobs suffered from, a neuroendocrine pancreatic tumor, his survival was not unusual. Jobs was famously tight-lipped about the condition and his treatment protocol, though he did get a liver transplant in 2009, following surgery in 2004 to remove the tumor from his pancreas. As the<a href="http://online.wsj.com/article/SB10001424052970203476804576613722391627248.html" target="_hplink"> <em>Wall Street Journal</em> reported</a> at the time of Jobs' death, patients usually undergo tumor removal either if the cancer is contained to the pancreas and has not spread -- or if it has spread to the liver. "If you think it is confined to the pancreas, there is quite a good hope that the patient has gotten rid of it once and for all," Michaela Banck, a pancreatic cancer expert at the Mayo Clinic told the <em>Journal</em>, adding that in cases where it has spread to the liver, "you can't ultimately cure it. The more tumor you remove, you buy time for the patient." Though Jobs rarely spoke of his illness, he shared his thoughts on death with some frequency, including during a 2005 Stanford <a href="http://abcnews.go.com/Technology/steve-jobs-death-20-best-quotes/story?id=14681795#5" target="_hplink">commencement speech</a>: <blockquote>No one wants to die. Even people who want to go to heaven don't want to die to get there. And yet death is the destination we all share. No one has ever escaped it. And that is as it should be, because death is very likely the single best invention of life. It is life's change agent. It clears out the old to make way for the new.</blockquote>

  • Ruth Bader Ginsburg

    In truth, it may have been Chief Justice Ginsburg's 1999 brush with colon cancer that saved her. Because she is a cancer survivor, Ginsburg gets routine CT scans as part of her yearly examinations. And in 2009, <a href="http://www.nytimes.com/2010/06/08/health/08brod.html" target="_hplink">one of these scans turned up a small tumor on her pancreas</a>. Unlike most pancreatic cancer patients, Ginsburg was lucky to find the cancer early and, as of this writing, remains cancer free following surgery to remove her spleen and part of her pancreas in 2009.

  • Luciano Pavarotti

    In July 2006, Pavarotti's manager announced that the famous opera singer had been diagnosed with pancreatic cancer and underwent surgery for the removal of a malignant mass, <a href="http://www.washingtonpost.com/wp-dyn/content/article/2006/07/07/AR2006070700319.html" target="_hplink">the <em>Washington Post</em> reported at the time</a>. "Fortunately, the mass was able to be completely removed at surgery," the manager said in a statement, according to <a href="http://www.washingtonpost.com/wp-dyn/content/article/2006/07/07/AR2006070700319.html" target="_hplink">the <em>Post</em> report</a>. "Mr. Pavarotti is recovering well, and his physicians are encouraged by the physical and emotional resilience of their patient." He eventually died in his Northern Italy home in September 2007, <a href="http://www.nytimes.com/2007/09/06/arts/music/06pavarotti.html?pagewanted=all" target="_hplink"><em>The New York Times</em> reported</a>.

    The actress first gained prominence for her award-winning role in <em>From Here to Eternity</em>, though she was perhaps better known for her television roles in "The Donna Reed Show" and "Dynasty." Reed was <a href="http://articles.latimes.com/1986-01-14/news/mn-27829_1_donna-reed" target="_hplink">first admitted to the hospital</a> with bleeding ulcers, but screening tests revealed that she was suffering from a tumor in her pancreas. She died of the cancer within six weeks of diagnosis.

  • Charlie Louvin

    The country music star <a href="http://articles.cnn.com/2011-01-26/entertainment/obit.louvin_1_charlie-louvin-great-atomic-power-ira?_s=PM:SHOWBIZ" target="_hplink">died in January 2011 of pancreatic cancer</a> at the age of 83. Louvin, a Grammy nominee and Country Music Hall of Famer, was diagnosed with stage 2 of the disease in 2010 after visiting his doctor with, <a href="http://blogs.tennessean.com/tunein/2010/07/07/happy-birthday-charlie-louvin/" target="_hplink">what <em>The Tennessean</em> reported was a "minor complaint."</a> He performed all the way up until the December before his death -- at one of those last appearances, <a href="http://www.people.com/people/article/0,,20460856,00.html" target="_hplink">People.com reported that he said</a>: "In my world, you are worthless if you can't continue. Show business is all I really know how to do. I would like for that to be the last thing I do."

  • Ben Gazzara

    Gazzara, a long-time dramatic actor, died in early 2012 from pancreatic cancer, <a href="http://www.nytimes.com/2012/02/04/movies/ben-gazzara-actor-of-stage-and-screen-dies-at-81.html" target="_hplink"><em>The New York Times</em> reported at the time</a>.

  • Dizzie Gillespie

That turned into the Dizzy Gillespie Memorial Fund and the Dizzy Gillespie Cancer Institute at Englewood -- an ongoing legacy that doesn't just help those with pancreatic cancer, but any musician who lacks health insurance or resources to help treat an illness.

  • Fred Gwynne

    The actor probably best known as the patriarch on the 1960s television series "The Munsters," Gwynne died from pancreatic cancer at age 66, <a href="http://articles.latimes.com/1993-07-03/news/mn-9469_1_fred-gwynne" target="_hplink">the <em>Los Angeles Times</em> reported at the time</a>. While his other roles included the television series "Car 54 Where Are You" and the play "Cat on a Hot Tin Roof," he always had a soft spot in his heart for Herman. "And I might as well tell you the truth. I love old Herman Munster. Much as I try not to, I can't stop liking that fellow," <a href="http://articles.latimes.com/1993-07-03/news/mn-9469_1_fred-gwynne" target="_hplink">the <em>LA Times</em> quotes him as saying</a>. Gwynne acted for 42 years, <a href="http://www.nytimes.com/1993/07/03/obituaries/fred-gwynne-popular-actor-is-dead-at-66.html" target="_hplink">according to <em>The New York Times</em></a>, and also once worked as both a writer and illustrator of children's books and as an advertising copywriter.

    Congress passes bill boosting pilots' rights

    Pilots' rights when dealing with Federal Aviation Administration disciplinary proceedings would receive a boost under a bill passed by Congress on Monday ? a measure written by a senator who was ordered to take remedial flying lessons by the agency after he landed his plane on a closed runway.

    The House approved the bill by voice vote. The Senate approved the measure last month. The bill now goes to the president for his signature.

    The bill was sponsored by Sen. James Inhofe, R-Okla., who sent workers on the ground scrambling when he landed his plane on a closed runway marked with a giant yellow X at an airport in South Texas in October 2010. Inhofe said later he didn't see the workers and trucks on the runway until it was too late to safely abort the landing. The FAA didn't post a notice online warning pilots of the runway closure until days after the incident, he said.

    Afterward, FAA officials ordered Inhofe, who has been flying for more than 50 years, to take remedial training as a condition for retaining his license. The senator complained he wasn't treated fairly by the agency and the process left him feeling powerless.

    The bill requires the FAA to provide pilots with timely notice of actions that might affect their license. Pilots also could appeal FAA decisions in federal court if a first appeal to the National Transportation Safety Board fails.

    The bill also clarifies what information the FAA must provide pilots when the agency issues orders that deny, amend, modify, suspend, or revoke a license. FAA would also be required to improve its program for notifying pilots of changes or events that could affect their flight plans, such as closed runways.

    FAA officials didn't reply to a request for comment.

    The bill was supported by the Aircraft Owners and Pilots Association and the Experimental Aircraft Association, the two largest groups representing private pilots.

    "Over the course of my years in Congress, I have helped an untold number of pilots facing the pressure of dealing with the FAA," Inhofe said in a statement. "This bill remedies many of the most serious deficiencies in the relationship between general aviation and the FAA, and ensures that pilots are, like everyone else, treated in a fair and equitable manner by the justice system."
